Residency needs to be checked every year. You cannot just rely on rolling forward from PY. Our clients and their families are very global now. They are now working abroad again and coming back to Australia!
There is much confusion on exactly how the tests work. If you accept a client’s residency based on “183 days”, then you need this refresher on residency. Previously benefits of resident / non-resident as now blurred with the changes to MRE and CGT discounting – so getting it right is paramount and not straightforward. The ATO have updated previous guidance from 1998 to accommodate new case law in TR 2022/D2. Furthermore, the existing tests are being reviewed and updated to provide more certainty of application.
